about that without also talking about plea bargaining. defendants are involved and defense attorneys have involved in the plea bargaining process, but not in a way that gives them very much say so, and i'll explain why. so i talked before about the charging function. well, very closely connectedded to that is plea bargaining. we have a system of justice where americans think there's all these trials going on in courtrooms and criminal courtrooms around the country watching law and gored, the television shows, and, well, the more trials going on in tv shows than there are in real life. we don't have a lot of trials going on, but we have a lot of guilty pleas. about 95% of all criminal cases are resolved by way of a guilty plea, not a trial, and the way it worked is this. the prosecutor brings the charges, as i mentioned before. the prosecutor has a lot of discretion in deciding what to charge, and the example about the cocaine, for example, that prosecutor can charge a felony, but if they want, it can be a dismirren. there's overcharging where they pile on charges because it's very ea

the fiscal year 2013 defense authorization bill. there are provisions that directly were prohibited in the defense authorization bill. i respect your knowledge of the senator from alabama and senator from maryland underfed species paper we spent three weeks and hundreds of hours of hearing an amendment to mark a. we said, for example that there would be no money for palm until we have a coherent strategy laid out by the administration as to how we were going to lament the base realignment. the fiscal year 13th defense national authorization act prohibited expending that money. now what if they cram into this 587 page bill? a hundred $20 million for regional health laboratory in civilian wastewater improvement on qualm. why? i asked a friend from alabama, whether to directly contradict the authorization bill that was just past is that nobody would be given for these purposes until they develop a strategy for the base realignment and qualm. if you because the senator from alabama and ireland know something more than the defense of the racers stayed, that we had debate and discussion h

services committee last month, i asked secretary of defense leon panetta and chairman of the joint chiefs of staff, martin dempsey, whether they agreed with a proposal reportedly developed by former secretary of state hillary clinton and former c.i.a. director david petraeus last summer to have the united states arm and train members of the syrian opposition. i was very pleased to hear both secretary panetta and chairman dempsey state that they supported this proposal which unfortunately was refused by the white house. what this means is that the president overruled the senior leaders of his own national security team who were in unanimous agreement that america needs to take greater action to change the military balance of power in syria. beyond providing arms to the opposition, we have other capabilities at our disposal that could make a decisive difference on the ground and save lives. i'll just give you two examples. nato has deployed patriot missiles batteries in turkey that are capable of shooting down syrian aircraft as far south as illepo. we could establish a limited no-fl

defense's ability to procure biofuels by $60 million is a step in the wrong direction. biofuels are an american industry, growing energy right here in our own backyard, energy at home, made in america. in my own state, the los alamos national lab is growing the next generation of algae feed stocks for future biofuels. so we're doing some great research in this area of biofuels. we also have a bio refinery facilities operated by saffire energy near columbus, new mexico. this facility is up and running and can produce 1.5 million gallons per year of fuel. that's fuel derived from these advanced generation algae. this story is not unique to new mexico. texas, california, missouri and iowa lead the united states with the number of biorefineries per state. this amendment limits opportunities for bioenergy companies across the united states. biofuels are a significant source of energy for the department of defense. we should provide as many opportunities as possible to grow this industry. we should maximize the long-term economic and national security benefits of u.s. biofuels. and it's for

taking threats from north korea very seriously, so seriously, in fact, that defense secretary chuck hagel has committed $1 billion to expand the west coast missile defense system. tom foreman has more on the threat and how the defense system is supposed to work. tom? >> the pentagon is acknowledging that north korea is becoming more of a global threat because of the speed at which it is developing its missile program and its nuclear weapon program. how does the military want to respond to that? at the front line by going to the pacific ocean where the fear is that north korea on its best day might be able to launch a missile that would go all the way out to hit some parts of the united states. what are they going to do about that? first of all, they want more radar support. they want a new base in japan here to be tracking ely on what's happening. they want to beef up missiles in alaska and california and, of course, they want steady monitoring from ships at sea from airplanes overhead and satellites all watching to see if north korea is going to launch at some point our way. how wo
